The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Class 5 (Minor Alterations in Land Use - Section 15305) as this is a minor right-of-way vacation that does not change land use or density of the surrounding properties.

EXECUTIVE SUMMARY
The request involves an existing project under construction located at the southeast corner of Kalmia Street and Washington Avenue at 24610 Washington Avenue, which is located in the City's Downtown Specific Plan area. The approved project consists of a +/- 50,000 square foot mixed-use building containing commercial and residential uses. The project's approved plans include modification of the Washington Avenue public right-of-way. The property was last subdivided in 1979 and is identified as Parcel 3 of Parcel Map 7704.

The property owner, SPE 906-090-014 LLC, has requested the vacation of approximately 3,181 square feet of Washington Avenue right-of-way within Parcel 3 consistent with the approved project plans. Engineering staff reviewed the request and found it complies with applicable state and local requirements. In this case, the right-of-way is no longer needed for future public use and is consistent with the Murrieta General Plan and Downtown Murrieta Specific Plan.
