RECOMMENDATION

recommendation
Authorize the City Manager, or their designee, to execute a First Amendment to the construction contract with Capital Construction, Inc., increasing the contract amount by $11,058.73;

Authorize an additional fifteen percent (15%) construction contingency of $18,476.06 for a total contract sum of $141,649.79;

Authorize the City Manager, or their designee, to approve Contract Change Orders not to exceed fifteen percent (15%) of the contract amount; and

Extend the contract term for eight (8) months.

PRIOR ACTION/VOTE
On June 17, 2025, City Council approved a contract with Capital Construction, Inc. for replacement of the emergency generator at Fire Station 3 in the amount of $112,115 (Vote 5-0);

On June 3, 2025, City Council approved Resolution No. 25-4836, approving the Capital Improvement Plan Budget for Fiscal Year 2025/26, and the Fiscal Years 2025/26 to 2029/30 Capital Improvement Plan (Vote 5-0).

DISCUSSION
The construction contract to replace the emergency generator at Murrieta Fire Station 3 was originally awarded to Capital Construction on June 17, 2025, to ensure compliance with Assembly Bill 944 and current regulatory standards, including California Air Resources Board (CARB) requirements. The contract recognized that Air Quality Management District (AQMD) fees and permit costs would be addressed once that amount was known. Additionally, during construction, unforeseen costs arose for removal of the existing generator foundation. The cost for these items totals $11,058.73.
