ABSTRACT
The purpose of this item is to award the construction contract for the Auto Mall, Date Street, and Hobie Circle Slurry Seal Project to the lowest responsive and responsible bidder and find the project to be exempt from CEQA.

Amend the Fiscal Year 2026/27 Capital Improvement Plan (CIP) Budget and establish an appropriation of $100,000 using Measure A Fund Unassigned Fund Balance into CIP No. 13080;
Find the Auto Mall, Date, and Hobie Slurry Seal Project, CIP No. 13080, MSD Project No. 26-010, to be exempt from CEQA and award the construction contract to Roy Allan Slurry Seal, Inc. in the amount of $79,665.72;
Authorize a 15% construction contingency of $11,949.86;
Authorize the Mayor to execute the construction contract; and
Authorize the Municipal Services Director and/or designee to approve contract change orders not to exceed fifteen percent of the contract amount.

PRIOR ACTION/VOTE
On June 3, 2025, the City Council approved Resolution No. 25-4836, approving the Capital Improvement Plan Budget for Fiscal Year 2025/26, and the Fiscal Year 2025/26 to 2029/30 Capital Improvement Plan, which included the Citywide Slurry Seal Project, CIP No. 13080 (Vote: 5-0).
STRATEGIC ALIGNMENT
This item aligns with the City Council goal to: aggressively pursue economic development relating to an administrative priority. This project will revitalize the subject streets by resurfacing the existing asphalt, in preparation to reconfigure the striping layout to allow more street parking for the local businesses.
DISCUSSION
The Auto Mall, Date, and Hobie Slurry Seal Project, CIP No. 13080, consists of striping removals, crack sealing, surface prep, street sweeping, traffic control, slurry sealing, and other ancillary work at Auto Mall Parkway, Date Street, and Hobie Circle. The intent of this project is to resurface and seal the subject streets in preparation for a revised striping configuration designed to increase the number of on-street parking spaces available for local businesses. Upon completion of the slurry seal work, the City's on-call striping contractor will install the new striping under separate contract. This project is funded utilizing Measure A (Fund 302).
The project includes slurry seal and other incidental work at the following locations:
• Auto Mall Parkway from Jefferson Avenue to Date Street;
• Date Street from Jefferson Avenue to Auto Mall Parkway; and
• Hobie Circle from Auto Mall Parkway to Date Street.
Project Bidding and Determination
The City conducted an informal bid process per the requirements of the Murrieta Municipal Code for Public Works construction contracts between $75,000 and $219,999 and received a total of three (3) construction bids. The bid results are as follows:

Staff has reviewed the bids and determined that the item prices are consistent with today’s construction market. Staff recommends that the construction contract be awarded to the lowest responsible bidder, Roy Allan Slurry Seal, Inc., in the amount of $79,665.72, for the total proposal cost, plus a 15% construction contingency of $11,949.86, for a total of $91,615.58.
PUBLIC NOTICING
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
CEQA AND REGULATORY OVERVIEW
Staff recommends exemption of this project from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Class 1 Categorical Exemption) of the CEQA Guidelines because this project involves “repair or maintenance” of existing infrastructure or facilities and is on the same site and serves the same purpose and capacity without expanded use.
FISCAL IMPACT
The total fiscal impact associated with the approval of this contract is $91,615.58, including the contingency. Staff recommends amending the Capital Improvement Plan Budget for Fiscal Year 2026/27 and establishing an appropriation of $100,000 using Measure A Fund Unassigned Fund Balance into CIP No. 13080.
The construction contract amount to be awarded is $79,665.72, plus an additional 15% contingency amount of $11,949.86, for a total not-to-exceed amount $91,615.58. Funding is available in CIP No. 13080 from Measure A (Fund 302).
