Environmental review is not required under the California Environmental Quality Act (CEQA) pursuant to the California Code of Regulations, Title 14, Chapter 3, Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, Cal. Code of Regs., Title 14, Chapter 3, because it has no potential for resulting in a physical change to the environment, directly or indirectly.

 

PRIOR ACTION/VOTE

 

On June 14, 2023, The Planning Commission of the City of Murrieta discussed and reviewed proposed additions to the Capital Improvement Plan Fiscal Years 2023/24 through 2027/28 for consistency with the goals and policies implementing the City of Murrieta General Plan 2035 and reported the findings to the City Council. (Vote 5-0).¹


EXECUTIVE SUMMARY

The proposed Capital Improvement Plan (CIP) projects are being presented to the Planning Commission to determine whether the CIP is consistent with the goals and policies of the General Plan 2035. The purpose of this review by the Commission is limited to reviewing CIP conformance with the General Plan’s applicable goals and policies and reporting those findings to the City Council. It does not include the consideration of budget, the review, determination, decision or recommendation of the individual CIP projects or which projects should be in the CIP.

 

BACKGROUND

The City’s CIP is a master plan addressing a long-term funding strategy to implement non-reoccurring major construction or repair projects or major master plan documents. CIP projects may include:

 

                     Acquisition of land and right-of-way.

                     Construction of buildings, roadways, bridges, drainage, and parks, including major repair, reconstruction, or replacement of capital improvements.

                     Purchase of major equipment.

 

Annually, the City Council, per California Government Code section 65403, adopts the five-year CIP to appropriate funding for new projects and amend existing projects as needed. On May 7, 2024, staff is presenting the proposed new CIP projects to the City Council during a workshop. The City Council is aware that staff is presenting the CIP additions to the Commission for a finding and recommendation regarding conformity with the City’s General Plan 2035 (General Plan) the following night.

California Government Code section 65401 generally provides that if a general plan has been adopted by a City, a list of the proposed public works projects (the CIP) shall be sent to the City’s Planning Commission for review and to report on each of the project’s conformity with the adopted general plan.

The CIP for FY 2024/25 through 2028/29 provides the following new projects as attached and described under Exhibit A. There are 25 projects for the Commission to determine conformity with the General Plan consisting of 13 new projects and 12 citywide annual recurring projects.

Ultimately, the City Council will evaluate the proposed CIP projects based on need, availability or restrictions on funding, timeliness, and resources. The last column of the CIP summary references the corresponding General Plan goal or policy; the full text for the goals and policies is provided in Exhibit B.  Additional detail related to each goal and policy can be found in the General Plan under each corresponding element.

Staff has reviewed the proposed capital improvement projects in conjunction with the General Plan and recommends that the Planning Commission find that the CIP covering FY 2024/25 through 2028/29 is consistent with the General Plan and report these findings to the City Council.
