Approve Amendment No. 2 to the Madison Avenue Improvement Project from Guava Street to Elm Street, CIP 8357 design agreement with Rick Engineering Company for additional engineering services in the amount of $87,128.34; and

 

Authorize the City Manager or her designee to execute the Amendment upon approval as to form by the City Attorney.

PRIOR ACTION/VOTE

On February 6, 2018, the City Council adopted Resolution No. 18-3850, entering into an Agreement with Rick Engineering Company for the environmental and engineering design services for the Madison Avenue Improvements project, CIP No. 8357 in the amount of $1,112,386 (Vote: 5-0).

 

On June 20, 2023, the City Council approved Amendment No. 1 to the Madison Avenue Improvement Project from Guava Street to Elm Street, CIP 8357 design Agreement with Rick Engineering Company for additional engineering services in the amount of $435,470
(Vote: 4-0-1).

 

On August 15, 2023, the City Council conducted a public hearing and adopted Resolution No. 23-4699, approving the Fiscal Year 2023/24 to Fiscal Year 2027/28 Capital Improvement Plan budget which included the Madison Avenue Improvements Project, CIP 8357 (Vote: 5-0).

 

CITY COUNCIL GOAL

Plan, program and create infrastructure development.

 

BACKGROUND

On February 6, 2018, the City Council adopted a resolution entering into an Agreement with Rick Engineering Company (REC) for the environmental and engineering design services for the Madison Avenue Improvements project, CIP 8357 in the amount of $1,112,386. The project involves construction of approximately one mile of Madison Avenue between Guava Street and Elm Street as a secondary classification roadway. Due to residential properties in close proximity to the east side of the road, the project anticipates constructing the full western half plus a portion of the eastern half necessary to develop one travel lane in each direction plus a center turn lane. The full eastern half will either be completed by a future development or CIP project.

 

A subsequent amendment to the original Agreement was approved on June 20, 2023, to restart the project due to delays associated with a General Plan Amendment that affected the project. Since the restart, some additional tasks have been identified that need to be completed that were not included in the original or amended scope of work.  These tasks include:

 

                     Cultural and Paleontological Resource report revalidation. Due to the age of the report, a revalidation is necessary, which involves additional AB 52 cultural consultation. A Paleontological Resource Impact Mitigation Program (PRIMP) will also be prepared.

                     Additional anticipated meetings, project management, and rate increases for the biological resources tasks for the project that were not included with Amendment No. 1.

                     Studies to determine the potential occurrence of Fairy Shrimp within the project area. The studies will include wet and dry season surveys with the results being incorporated into the project CEQA document.

 

City staff has reviewed the proposal from REC and determined the proposed amounts are appropriate for the scope of work and consistent with pricing for similar scopes of work. The project schedule anticipates construction in 2025.

 

FISCAL IMPACT

Adequate funding is available in CIP No. 8357 to cover the $87,128.34 for this Amendment.
