Adopt Resolution No. 24-4724 entitled: A Resolution of the City Council of the City of Murrieta, California, Authorizing the City Manager to Accept Grant Funding from the State of California Department of Justice (DOJ), Office of Attorney General to Implement Strategies to Reduce Underage Tobacco Use in an Amount not to Exceed $134,061; Agreeing to the Terms of that Grant by Authorizing the City Manager to Sign the Attached DOJ Memorandum of Understanding and Increasing the Police Department’s Revenue and Expense Budget by the Actual Amount Awarded over the next three Fiscal Years as Follows: FY 2023/24 $44,687, FY 2024/25 $44,687, and FY 2025/26 $44,687.

CITY COUNCIL GOAL
Provide a high level of innovative public safety.
BACKGROUND
To continually increase service levels to the community, the Police Department regularly seeks and applies for Federal, State, and local government grant funds. The Police Department applied to the DOJ and was awarded a three-year tobacco enforcement grant. The project will entail conducting (a) compliance checks and enforcement operations on all existing tobacco retailers, (b) classes for elementary, middle, and high school students, and (c) educational meetings for licensed tobacco retailers in the city.
The Murrieta Police Department and Murrieta Valley Unified School District (District) will collaborate to develop and schedule classes for all students at the district’s elementary, middle, and high school campuses. The project’s goals will be to increase educational opportunities for tobacco retailers to comply with federal, state, and local laws that regulate the sale of tobacco products to minors (under 21 years). Another fundamental goal of the project will be to increase awareness among students on the negative health effects of consuming tobacco products (i.e., cigarettes, e-cigarettes, vapes, etc.).
The project objective will be to assist tobacco retailers in achieving 100% compliance with federal, state, and local laws within the project’s three-year performance period and conduct semiannual classes and distribution of information to District students aimed at discouraging and reducing the use of tobacco products at and off school campuses.
FISCAL IMPACT
This grant is for $134,061, with the State providing one hundred percent reimbursement for the grant as identified on the attached grant Memorandum of Understanding (MOU) and attached Tobacco Law Enforcement Grant DOJ-PROP56-2023-24-1-017 Proposal. There is no match or cost share required for participation in the Tobacco Law Enforcement Grant. However, this grant is reimbursable in nature, requiring the City to expend funds prior to requesting reimbursement.
The following are the budget allocations to implement the proposed project during its three-year performance period. These funds will cover the overtime and equipment costs associated with the program. Establish a Revenue Budget in General Ledger Account 3580030-42221, Job Ledger Account 50151358-42221 by $44,687, and the Expenditure Budgets in General Ledger Account 3580030-51040, Job Ledger Account 50151358-51040 by $43,712 and General Ledger Account 3580030-60880, Job Ledger Account 50151358-60880 by $975. The budget appropriation is the same for all three years of the grant (Fiscal Years 2023/24, 2024/25, and 2025/26).
