SB 1205 Compliance Report for 2025 State-Mandated Annual Fire Inspections

ABSTRACT

In 2018, Senate Bill 1205 (SB1205) was signed into law. SB 1205 amended the California Health and Safety Code (HSC) as of January 1, 2019, to add Section 13146.4. This new provision requires fire departments, which are mandated to perform annual inspections pursuant to Sections 13146.2 and 13146.3 of the HSC, to report their compliance annually to their administrating authority, which, in the case of the Murrieta Fire & Rescue, is the City Council. HSC sections 13146.2 and 13146.3 mandate that fire departments conduct annual inspections of all public and private schools, hotels, motels, lodging houses, and apartment houses. Pursuant to the new HSC Section 13146.4, Murrieta Fire & Rescue is submitting the report attached as Exhibit “A” to the attached Resolution to demonstrate the Fire Department’s compliance with these sections.

 

Murrieta Fire & Rescue’s Community Risk Reduction Division has achieved 100% compliance in inspecting the State-mandated occupancies within the City of Murrieta (City). In Murrieta, there are 36 registered schools (E occupancies), six hotels (R-1 occupancies), and 368 Multi-family Dwelling Buildings (R-2 occupancies). In 2025, MFR fire inspectors completed all 410 State-mandated inspections. It is worth noting that the properties included in these categories are generally very large, and it takes a considerable amount of time to complete a full fire inspection on these properties. In 2025, inspecting the 368 Multi-family Dwelling Buildings required the inspection of 7,204 dwelling units, compared to 5,284 units in 2024, an increase of more than 21%. The Murrieta Fire & Rescue Community Risk Reduction Division has a plan that will ensure SB 1205 inspections will remain at 100% compliance, even with the substantial growth of R-1 and R-2 occupancies in the City.

Adopt Resolution No. 26-4936 entitled: A Resolution of the City Council of the City of Murrieta, California, Acknowledging Receipt of a Report Made by the Fire Marshal of the Murrieta Fire Department Regarding the Annual Inspection of Certain Occupancies Pursuant to Sections 13146.2 and 13146.3 of the California Health and Safety Code.
