Local Agency Designated Filers - Conflict of Interest Code Adoption
end

ABSTRACT
As part of compliance with the Political Reform Act (Government Code §§ 81000-91014), the City of Murrieta must review its Conflict of Interest Code every other year to ensure that the designated filers reflect the City’s agents who make, or participate in making, or influence governmental decisions in which they might have a private financial interest. Since the last review in 2024, several amendments to the code were proposed to be made, including removal of positions no longer in the City’s organizational structure and the addition of new positions.

STRATEGIC ALIGNMENT
This item aligns with the City Council goal of: maintaining a high performing organization that values fiscal sustainability, transparency, accountability and organizational efficiency relating to an administrative priority. The proposed document is part of the City's compliance with the State of California’s Political Reform Act to ensure transparency in governmental decisions made by City agents.
DISCUSSION
The Fair Political Practices Commission (FPPC) was created as part of the Political Reform Act (PRA) to ensure government transparency and the disclosure of contributions received by those who make governmental decisions. As part of the PRA, cities must adopt a Conflict of Interest Code (COI Code), which lists designated positions as Form 700 filers because they make, or participate in making, or influence governmental decisions in which they might have a private financial interest. The City of Murrieta (City) adopted the COI Code on December 17, 1991, and has since undergone various amendments to the designated filers list and disclosure categories as employees and/or positions have changed over time.
The PRA requires local agencies to review the COI Code and the list of designated positions biennially to determine whether amendments are necessary. Since 2024, the City has created, restructured, and revised the COI Code to eliminate positions that no longer exist in the City’s structure. The City Clerk's Department worked with the City’s department heads and the City Attorney’s Office to review and amend the current Conflict of Interest Code by evaluating positions in the City’s organizational chart and the duties and responsibilities of those positions.
After a collaborative review, the following amendments are proposed at this time:

In addition to a review of the positions, the City Clerk’s Department has reformatted the Conflict of Interest Code for easier accessibility and reference by Departments. On September 14, 2026, the City Clerk Department sent out notice to the filers advising of the date the City Council will take action on the proposed Conflict of Interest Code. Resolution No. 26-4979 repeals previous versions of the Conflict of Interest Code; adopts the revised list of designated employees; and includes the disclosure categories for each position which specifies what types of economic interests are reportable on their Form 700.
