Award the construction contract for the Fiscal Year (FY) 2022/23 Pedestrian Safety Enhancement Project, Capital Improvement Plan (CIP) No. 13044, and the FY 2023/24 Pedestrian Safety Enhancement Project, CIP No. 13046, to LC Paving & Sealing, Inc., in the amount of $907,067.75;
Authorize a fifteen percent (15%) construction contingency of $136,060.16;
Amend the CIP Budget for FY 2024/25, and the FY 2024/25 to 2028/29 CIP to establish appropriation as described in the fiscal impact statement; and
Authorize the City Engineer to approve contract change orders not to exceed fifteen percent (15%) of the contract amount.

PRIOR ACTION/VOTE
On December 7, 2021, the City Council approved Resolution No. 21-4502, authorizing the allocation of Community Development Block Grant funds for FY 2022/23, which included the funding of Pedestrian Safety Enhancements Project FY 2022/23, CIP No. 13044, and authorized the City Manager to execute the required supplemental agreements with the County of Riverside (Vote 5-0).
On November 15, 2022, the City Council approved Resolution No. 22-4626, authorizing the allocation of Community Development Block Grant funds for FY 2023/24, which included the funding of Pedestrian Safety Enhancements Project FY 2023/24 CIP No. 13046 and authorized the City Manager to execute the required supplemental agreements with the County of Riverside (Vote 4-0).
On June 4, 2024, the City Council approved Resolution No. 24-4745, approving the Capital Improvement Plan Budget for Fiscal Year 2024/25, and the Fiscal Year 2024/25 to 2028/29 Capital Improvement Plan, which included the Pedestrian Safety Enhancement Projects CIP No. 13044 and CIP No. 13046 (Vote 5-0).
CITY COUNCIL GOAL

BACKGROUND
The Pedestrian Safety Enhancement Projects for FY 2022/23 and FY 2023/24, CIP No. 13044 and CIP No. 13046, respectively, consist of the removal, installation, and retrofitting of access ramps, crosswalks, sidewalks, spandrels, and other ancillary improvements at intersections to improve access for disabled persons under the Americans with Disabilities Act (ADA). This project is funded utilizing the Community Development Block Grant (CDBG). CDBG funds are federally funded through the Department of Housing and Urban Development (HUD) and are administered by the County of Riverside Department of Housing and Workforce Solutions (HWS).
City staff combined CIP Project Nos. 13044 and 13046 and advertised as one project to allow for greater efficiency in construction and to achieve a more desirable economy of scale. In addition, reconciliation was performed between the City’s project ledger and the County’s project ledger for all previous Pedestrian Safety Enhancement Projects (CIP Nos. 13040, 13045, 13044, and 13046, respectively). City staff will allocate the balance of unused CDBG fund savings from prior years' Pedestrian Safety Enhancement Projects into CIP No. 13046, bringing the total CDBG and Gas Tax fund balances in CIP No. 13046 to $1,280,169.63, per the Amended Supplemental Agreement for the use of 2023/24 CDBG Funds between the City and HWS. A breakdown of the CDBG funds and Gas Tax that will be reconciled and reallocated into CIP No. 13046 is depicted below:

The project includes the removal of existing concrete and installation of ADA-compliant access ramps, sidewalks, crosswalks, spandrels, striping, and other ancillary improvements at the following locations:

Project Bidding and Determination
The City advertised the project on January 6, 2025, and received a total of six (6) construction bids on February 5, 2025. The basis of the bid for determining the low bidder was defined in the specifications as the sum of the total Base Bid Items and Additive Bid Items. The bid results are as follows:

After a thorough review of the contractor’s proposals and bid documents provided at the time of bid opening, it has been determined that the apparent low bidder, TVR Construction Engineering LLC (TVR), has provided a non-responsive bid and has been disqualified from bidding. This determination is due to TVR’s failure to submit several required City and federal bid forms and failure to submit all required wet signed original documents within three (3) business days of bid opening. Staff subsequently conducted a review of the second low-bidding contractor, LC Paving & Sealing, Inc., and found their proposal and bid package to be satisfactory and in compliance with all the necessary requirements. Staff recommends awarding the construction contract to LC Paving & Sealing, Inc.
Sufficient funding is available for the base bid items and the additive bid items. Therefore, staff recommends awarding the full bid amount. The Public Works Engineering Department has reviewed the bids and determined that the item prices are consistent with today’s construction market and recommends that the contract be awarded to the lowest responsible bidder, LC Paving & Sealing, Inc., in the amount of $907,067.75, for the Total Base Bid Items and the Additive Bid Items, plus a fifteen percent (15%) contingency of $136,060.16, for a total of $1,043,127.91.
FISCAL IMPACT
The proposed contract amount to be awarded is $907,067.75, plus an additional fifteen percent (15%) contingency amount of $136,060.16, for a total of $1,043,127.91. Funding will be available in CIP No. 13044 and CIP No. 13046 after the successful reconciliation and transfer of CDBG fund savings and Gas Tax from previous years into CIP No. 13046.
Staff recommends an amendment to the CIP Budget for FY 2024/25 and the FY 2024/25 to 2028/29 CIP for the unallocated CDBG grant funds, and combining CIP 13040, 13044, 13045, and its funding sources into CIP 13046.
