RECOMMENDATION

Award the construction contract for the Sykes Ranch Park Improvement Project, CIP 22010, to the lowest responsible bidder, Land Forms Landscape Construction, Inc., in the amount of $183,226.00 with a 15% contingency;

 

Authorize the Mayor to execute the agreement; and

 

Authorize an additional budget appropriation to CIP 22010 for additional project costs.

PRIOR ACTION/VOTE

On August 15, 2023, the City Council adopted Resolution No. 23-4699, approving the Fiscal Years 2023/24 to 2027/28 Capital Improvement Plan (Vote: 5-0).

BACKGROUND

Sykes Ranch Park (Park), located at the corner of Hayes Avenue and Semillon Lane, is a site of importance for the City of Murrieta as the vestiges of the Sykes family ranch can still be seen on the property today. The recreation park was originally built by the developer over 15 years ago and contains walking paths, a tot lot, and is a popular gathering place for local families.


To pay homage to the original windmill, which no longer exists, that once used to pump water to the property, a modern windmill was installed at the park in April 2023, adjacent to the original pump house that still stands on the property. The current project will complete planned improvements to the park and includes adding sidewalks to create a walking path tour of the historic relics at the site, fencing, furnishings, additional landscape, new signage at the entry to the park, as well as historical markers that will provide historic information to park guests (Project).


The City publicly advertised the Project in a regional newspaper on October 9, 2023; and again, on October 16, 2023, and received nine (9) construction bids on November 6, 2023, as follows:

The bids were reviewed, and it was determined that the item prices are consistent with today’s construction market. However, the contractor that submitted the initial lowest bid, RG General Engineering, Inc., was deemed non-responsive because they, as the prime contractor, indicated in their proposal that their subcontractors would perform work that amounts to eighty-six percent (86%) of the Contract Price of the Project. The 2015 Edition of the Standard Specifications for Public Works Construction (Section 2 - Scope and Control of the Work, Subsection 2-3.2 Self Performance), commonly known as the “Green Book”, states that prime contractors bidding on a Public Works project “…shall perform, with its own organization, Contract work amounting to at least 50 percent of the Contract Price…”


Subsequently, staff recommends that the contract be awarded to the lowest responsible bidder, Land Forms Landscape Construction, in the amount of $183,226, plus a fifteen percent (15%) contingency. No bid protests were received for the Project.

 

FISCAL IMPACT

CIP No. 22010 has a remaining budget of $180,387.12. However, to cover the cost of permit and inspection fees, construction management, construction, construction contingency, and administration, an additional appropriation of $73,290 is necessary from Parkland DIF Unassigned Fund Balance. The allocation of the proposed budget is listed below.
