Approve the Agreement for right-of-way consulting services for the Keller Road at I-215 Interchange, Capital Improvement Plan No. 8449, with Monument ROW, Inc., in the amount of $382,682.16;
Authorize a 10% contingency of $38,268.21; and
Authorize the City Manager to execute the Agreement and any amendments to the Agreement not-to-exceed 10% of the contract amount.

PRIOR ACTION/VOTE
On June 3, 2025, the City Council adopted Resolution No. 25-4836, approving the Capital Improvement Plan budget for Fiscal Year 2024/25, and the Fiscal Year 2024/2025 to 2028/29 Capital Improvement Plan, which included the Keller Road at I-215 Interchange project, CIP No. 8449 (Vote: 5-0).
On August 19, 2025, the City Council approved an Agreement for Engineering Design Services for the Keller Road at I-215 Interchange, CIP 8449, with Mark Thomas & Company, Inc. (Vote:5-0).
On October 21, 2025, the City Council approved Amendment No. 10 to the Design Services Agreement for the Keller Road at I-215 Interchange, CIP 8449, with Jacobs Engineering Group, Inc.(Vote: 4-0-1).
CITY COUNCIL GOAL
Plan, program and create infrastructure development.
DISCUSSION
The Keller Road at Interstate 215 (I-215) Interchange Project, CIP 8449, is a top City infrastructure priority project. The project was initiated in 2010 and proposes to construct a new interchange one (1) mile south of the existing Scott Road interchange on I-215. Jacobs Engineering Group (JEG) has completed the project’s environmental and preliminary engineering documents to date. The City recently entered an agreement with Mark Thomas & Company to complete the final Plans, Specifications, and Estimates (PS&E) documents. After the PS&E documents are substantially complete, right-of-way services will need to commence to acquire the right-of-way properties necessary for the construction of the interchange design.
Acquisition of right-of-way requires specialty professional consulting services. Based on the anticipated interchange design, right-of-way will need to be acquired from 25 parcels, which are a mix of vacant and improved residential and commercial properties, along with developer-owned recreational lands and an environmental conservation site, which may present unique challenges. Completing the necessary property acquisitions within a tight timeframe to meet the project schedule goals will also require extensive coordination with all stakeholders.
On August 8, 2025, the City advertised a Request for Proposal (RFP) for right-of-way services for the project via the electronic bidding portal, PlanetBids. The City received two proposals and sealed bids on August 27, 2025. Monument ROW, Inc. (Monument) was determined to be the most qualified firm. Monument specializes in comprehensive right-of-way acquisition services, including project management, property appraisal, acquisition, easement negotiation, utility coordination, and right-of-way certification. After negotiations with Monument, staff settled on the scope of work outlined in the Agreement for a fee of $382,682.16, plus a 10% contingency in the amount of 38,268.21, totaling $420,950.37. Monument’s scope of services for 25 parcels will include preparation of title reports, appraisals, appraisal reviews by a separate appraiser on behalf of Caltrans, negotiations, utility/Caltrans coordination, and project management
Monument is ready to begin the right-of-way acquisition services upon approval of the Final Environmental Document by Caltrans.
FISCAL IMPACT
Funding for the contract amount of $382,682.16, plus the ten percent (10%) design contingency of $38,268.21, if needed, is available in CIP No. 8449.
