PRIOR ACTION/VOTE
On October 4, 2011, the City Council adopted Resolution No. 11-2798, authorizing entering into Cooperative Agreement 08-1519 with Caltrans for the Project Initiating Document for a new Interchange at Interstate 215 and Keller Road (Vote 5-0).
On May 5, 2015, the City Council adopted Resolution No. 15-3371, authorizing entering into a Design Cooperative Agreement 08-1601 with Caltrans for the Interstate 215/Keller Road Undercrossing (Vote 5-0).
On June 4, 2024, the City Council approved joint Resolution No. 24-4745, et al., approving the Capital Improvement Plan Budget for Fiscal Year 2024/25, and The Fiscal Years 2024/25 to 2028/29 Capital Improvement Plan, which included the Interstate 215 at Keller Road Interchange Project, CIP No. 8449 (Vote 5-0).

BACKGROUND
The City previously entered into Cooperative Agreements with Caltrans in 2011 and 2015 for the Project Initiating Document (PID) and the Project Authorization & Environmental Document (PA&ED) phases of the Interstate 215 and Keller Road Interchange project. To proceed with the next phase required in the design process, it is necessary to enter into a new cooperative agreement with Caltrans to address Plans, Specifications, and Estimates (PS&E) and Right of Way (ROW) phases of work. The attached Cooperative Agreement No. 08-1789 is the State’s standard form agreement for work within State ROW.
The City is currently processing the Draft Environmental Document (DED) with Caltrans and expects to have a document ready for public review by the end of October 2024. The public review period for the DED would close by mid-December of this year. Approval of the DED will allow the City to complete the PS&E and ROW phases of work. The current schedule provides for the project approval and start of construction in 2026, with project completion and opening to traffic in late 2027.
The proposed Cooperative Agreement (Attachment 2) identifies the scope of work and responsibilities for each of the parties associated with the PS&E and ROW phases of work. The City is the “implementing agency” for these phases, which means that it is responsible for managing the scope, cost, schedule, and quality of these work activities. PS&E includes the development of the plans, specifications, and cost estimate, as well as obtaining any necessary resource agency permits and the advertising and award of the construction contract. Examples of the environmental permits this project requires include the Regional Water Quality Control Board and National Pollution Discharge Elimination System (NPDES), US Army Corps of Engineers, California Department of Fish & Wildlife, and air quality. The ROW phase includes coordinating with utility owners for the protection, removal, and/or relocation of utilities, as well as acquisition of necessary right-of-way interests, and post-construction work related to recording or relinquishing right-of-way.
FISCAL IMPACT
There is no direct cost to the City for the implementation of the Cooperative Agreement. The costs related to the Plans, Specifications, and Estimates (PS&E) and Right of Way (ROW) work components are those connected with the Design Services Agreements with our designated design consultants.
