Award the construction contract for the Cal Oaks Sports Park Tennis Court Lighting Project, Capital Improvement Project No. 22017, to Facility Solutions Group, Inc., in the amount of $135,107.97, plus a 15% contingency; and


Authorize the Mayor to execute the agreement.

PRIOR ACTION/VOTE

On June 4, 2024, the City Council adopted Joint Resolution No. 24-4745, approving the Capital Improvement Plan budget for Fiscal Year 2024/25 and the Capital Improvement Plan for Fiscal Years 2024-25 to 2028/29 (Vote: 5-0).

BACKGROUND

The City of Murrieta (City) operates three (3) tennis courts on City-owned property. Two (2) are located at California Oaks Sports Park (Cal Oaks), and the third is located at the Community Center on Juniper Street. Currently, the Community Center is the only location that has a lit tennis court for nighttime play. Since tennis is a year-round sport and the City operates a limited number of tennis courts, the Community Services Department (CSD) has created a Capital Improvement Project (CIP) to install new lighting for the courts at Cal Oaks (Project). The Project includes installing in-ground light posts, LED fixtures, and wiring to connect the new lights to a subpanel that will allow staff to schedule when lights will operate.

 

Staff recommends bypassing the traditional competitive bidding process and using Job Order Contracting (JOC) through a cooperative purchasing organization to save time and effort. This Project will serve as a test case for completing smaller public works projects using this type of contracting.

 

While the City Council is being asked to consider waiving the usual competitive bid process, it is important to note that City staff is recommending using a contractor, Facility Solutions Group, Inc. (FSG). FSG was awarded a contract via a competitive bidding process by Sourcewell, an organization that the City has used before for purchasing vehicles and other goods, and for construction projects. Sourcewell’s bidding process conforms to the California Public Contract Code, including the prevailing wage requirement. Invitations for Bids were advertised to contractors throughout Southern California in several newspaper publications, including the Press-Enterprise, the Orange County Register, and the Los Angeles Times. Attachment 3 to this agenda report shows all of the publications that were used to advertise the Invitation for Bids. Pre-bid conferences were held in several locations to give all firms an equal opportunity to participate. Only highly qualified contractors with the lowest bids were selected to receive contracts. The process required contractors to bid an adjustment factor that was applied to a detailed catalogue of construction tasks with preset unit prices based on local labor, material, and equipment rates.

 

Through its membership in Sourcewell, the City of Murrieta was able to select FSG from the qualified firms that provided project prices that are transparent, detailed, and guaranteed up front. FSG has provided a JOC proposal for the construction and installation of the tennis court lighting that is broken down into a detailed list of tasks with unit prices and quantities. The cost proposal then underwent due diligence review by staff.

 

FISCAL IMPACT

There is funding available in CIP 22017 to cover construction costs and contingency.
