ABSTRACT
The purpose of this item is to award the construction contract for the Citywide Sidewalk Replacement Program to the lowest responsive and responsible bidder, find the project to be exempt from CEQA, and amend the Capital Improvement Plan (CIP) budget to reallocate available savings from prior years’ Citywide Sidewalk Replacement Projects into CIP No. 13064.

Amend the Capital Improvement Plan Budget for Fiscal Year 2025/26 by transferring the Measure A remaining funding from CIP Nos. 8293, 13051, and 13073 in the combined amount of $625,618.28 into CIP No. 13064;
Find the Citywide Sidewalk Replacement Program 2026, CIP No. 13064, MSD Project No. 26-003, to be exempt from CEQA and award the construction contract to Carter Enterprises Group, Inc., dba Pavement Rehab Company, in the amount of $411,888;
Authorize a 15% construction contingency of $61,783.20;
Authorize the Director of Municipal Services, or his designee, to approve contract change orders not to exceed 15% of the contract amount; and
Authorize the Mayor to execute the construction contract.

PRIOR ACTION/VOTE
On June 3, 2025, the City Council approved Resolution No. 25-4836, approving the Capital Improvement Plan Budget for Fiscal Year 2025/26, and the Fiscal Year 2025/26 to 2029/30 Capital Improvement Plan, which included the Citywide Sidewalk Replacement Projects CIP Nos. 8293, 13051, 13064, and 13073 (Vote 5-0).
STRATEGIC ALIGNMENT
This item aligns with the City Council goal of: planning, programming and creating infrastructure development relating to priority Tier 1. This project includes the correction of approximately 400 ADA barriers throughout the City.
DISCUSSION
The Citywide Sidewalk Replacement Program 2026, CIP No. 13064, consists of the removal and replacement of various damaged sidewalk panels, grinding of raised sidewalk panel lips, miscellaneous asphalt repairs, and other ancillary improvements at various citywide locations mainly along the corridor of Whitewood Road, between Murrieta Hot Springs Road and the northern city limits near Mapleton Street. This project aims to improve access for all Murrieta residents and ensure that pedestrian paths of travel comply with the Americans with Disabilities Act (ADA). This project is funded with Measure A (Fund 302) funds.
Staff combined CIP Project Nos. 8293, 13051, 13064, and 13073, and advertised as one (1) project under CIP No. 13064 to allow for greater efficiency in construction and to achieve a more desirable economy of scale. Staff recommends reallocating the balance of unspent Measure A fund from other years’ Citywide Sidewalk Replacement Projects into CIP No. 13064, bringing the total Measure A balance in CIP No. 13064 to $675,618.28. A breakdown of the reallocation of Measure A funds from various Citywide Sidewalk Replacement Projects into CIP No. 13064 is as follows:

The project includes removal and replacement of existing sidewalk panels, concrete grinding, asphalt repairs, and other ancillary work at the following location:
• Base Bid - Whitewood Rd. between Murrieta Hot Springs Rd. and Los Alamos Rd.
• Additive Bid 1 - Whitewood Rd. between Los Alamos Rd. and Hunter Rd.
• Additive Bid 2 - Whitewood Rd. between Hunter Rd. and the Northern City Limits
• Additive Bid 3 - Various Citywide Locations
PROJECT BIDDING AND DETERMINATION
The City advertised the project on April 8, 2026, and received a total of 11 construction bids on April 30, 2026. The basis of the bid for determining the low bidder was defined in the specifications as the sum of the total Base Bid Items and all Additive Bid Items. The bid results are as follows:

Staff elected to utilize Additive Bids 1, 2, and 3 (Bid Items 13 through 38). Bid Items 13 through 38 were advertised on the Bid Sheet as Additive Bids to allow the City to analyze the bid items’ costs and either accept or reject any or all the additive bids based on the final cost of the overall project and the availability of funding. The low bid cost came in favorably, and sufficient funding is available for the Base Bid and all Additive Bids. Therefore, staff recommends awarding the full bid amount.
Staff have reviewed the bids and determined that the item prices are consistent with today’s construction market. Staff recommends that the construction contract be awarded to the lowest responsible bidder, Carter Enterprises Group, Inc., dba Pavement Rehab Company, in the amount of $411,888.00, for the total Base Bid and Additive Bids 1, 2, and 3 (Bid Items 13 through 38), plus a 15% construction contingency of $61,783.20, for a total of $473,671.20.
PUBLIC NOTICING
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
CEQA AND REGULATORY OVERVIEW
Staff recommends exemption of this project from the California Environmental Quality Act (CEQA) pursuant to Section 15302 (Class 2 Categorical Exemption) of the CEQA Guidelines because this project involves “replacement or reconstruction” of existing infrastructure or facilities and is on the same site and serves the same purpose and capacity as the facility being replaced without expanded use.
FISCAL IMPACT
The fiscal impact for the approval of the construction contract is $411,888, plus a 15% contingency amount of $61,783.20, for a total not to exceed amount of $473,671.20. Funding will be available in CIP No. 13064 after the successful reallocation and transfer of available Measure A funds from CIP Nos. 8293, 13051, and 13073 in the combined amount of $625,618.28 to CIP No. 13064.
If City Council approves the construction contract, staff recommends an amendment to the FY 2025/26 CIP Budget for FY 2025/26 and the FY 2025/26 to 2029/30 Capital Improvement Plan to reallocate the balance of Measure A funds from CIP Nos. 8293, 13051, and 13073 in the combined amount of $625,618.28 into CIP No. 13064.
