BACKGROUND
On September 10, 2014, Governor Brown signed into law the Healthy Workplaces, Healthy Families Act of 2014, to provide employees working in California for thirty (30) or more days within a year paid sick days, to be accrued at a rate of no less than one (1) hour for every thirty (30) hours worked, beginning July 1, 2015. The City of Murrieta (City) approved Administrative Policy No. 500-05 Part-Time Sick Leave to implement the requirements.
On October 4, 2023, Senate Bill 616 (SB 616) was signed into law amending the Healthy Workplaces, Healthy Families Act of 2014, effectively increasing the number of paid sick days employees are entitled to per year of employment and the minimum number of paid sick days employees may carry over from one year of employment to the next beginning January 1, 2024. SB 616 expanded mandatory paid sick leave from three (3) days or twenty-four (24) hours to five (5) days or forty (40) hours and permits the City to continue providing paid sick leave at one (1) hour for every thirty (30) hours worked and permits an annual usage cap of forty (40) hours.
In accordance with the changes in law, staff recommends that the City Council adopt Resolution No. 24-4767 (Attachment 1), which approves Part-Time Sick Leave and supersedes Administrative Policy No. 500-05.
FISCAL IMPACT
The City currently employs 43 part-time employees with an average hourly rate of pay of $21.02. The proposed policy increases the number of eligible sick time hours to 40 (an increase of 16 hours). While the paid sick day hours used by the part-time employee would offset their scheduled work hours, additional staff might be called in to cover the vacant shift. Assuming full utilization, the fiscal impact would be approximately $14,465. Finance will monitor the Personnel costs in the Operating Budget and include any increases associated with this policy in a future Budget Update if needed.
