BACKGROUND
The Police Department entered into a one-year agreement with Performa Labs for the period between July 2023 and July 2024 for $58,300. This amendment to the agreement (Attachment 1) adds an additional six (6) months for the remainder of this calendar year and an additional two (2) years after. The cost for the extension of $156,400 will be paid over the next three (3) fiscal years. Staff requests that the City Council also authorize the City Manager to execute additional amendments not to exceed 10% of the total added contract value, or $15,640, in the event additional training services are needed.
This training application assists with mandatory training required by the Commission on Peace Officer Standards and Training (POST) for all sworn personnel. Without utilizing this application, officers would need to attend in-person training, resulting in overtime pay. This vendor provides the officer with actual body-worn camera footage in the interactive application, which is new to law enforcement. This new technology, combined with the POST courses, has been proven by law enforcement agencies to lower use of force incidents.
Performa Labs' training application is unique and one-of-a-kind. This vendor is the only one offering an application for training that has historically only been offered in person. There are no competitors currently. Performa Labs offers seven courses, all of which are POST-approved. The Police Department has seen its value and would like to extend the agreement to a three-year period.
By purchasing Performa Labs' training application, the City will save money on overtime costs and travel reimbursement. Officers currently need to attend in-person courses, which results in overtime and, in some instances, the cost of travel, including lodging and meals.
Going to a three-year contract will help stagger the training over that period and allow sworn personnel to comply with POST on two separate training cycles.
Competitive bidding procedures may be dispensed when a commodity can be obtained from only one vendor in accordance with Municipal Code Section 3.08.280.B Exceptions to Competitive Bidding Requirement. The police department has an approved sole source to satisfy the procurement requirements.

Funding for this agreement is available in the amount of $75,000 in the Fiscal Year 2024/25 Budget. Additional funding beyond the current fiscal year will be requested as part of future budget requests.
