Adopt Resolution No. 23-4711, entitled: A Resolution of the City Council of the City of Murrieta, Authorizing the Extension of the Service Fee Collected on behalf of the Riverside County Abandoned Vehicle Service Authority until May 2034; and

 

Upon approval from the City Attorney, authorize the City Manager to execute an agreement with the County of Riverside to participate in the Vehicle Abatement program.

PRIOR ACTION/VOTE

On July 6, 1993, the City Council adopted Resolution No. 93-225, establishing a service authority for abandoned vehicle abatement (Vote: 4-0-1).

 

On June 1, 1999, the City Council adopted Resolution No. 99-653, extending the sunset date for five years for the abandoned vehicle abatement program (Vote: 5-0).

 

On July 16, 2002, the City Council adopted Resolution No. 02-1061, extending the sunset date to May 2014 for the abandoned vehicle abatement program (Vote: 5-0).

 

On March 5, 2013, the City Council adopted Resolution No. 13-3056, extending the sunset date to May 2024 for the abandoned vehicle abatement program  (4-0-1).

BACKGROUND

The Riverside County Abandoned Vehicle Abatement Service Authority (AVA Authority) was formed on or about June 1, 1994. The AVA Authority was made possible through provisions of California Vehicle Code Sections 9950.7 and 22710 enacted by the Legislature in 1990. The legislation authorized the establishment of a service authority and imposition of a service fee on all registered motor vehicles located within a county for the purpose of removing abandoned vehicles.

Beginning in June 1994 and continuing to the present, the AVA Authority has been the recipient of service fees collected on its behalf by the California Department of Motor Vehicles.  The service fees received by the AVA Authority are used to reimburse local agencies for a portion of their costs incurred as a result of the abatement, removal, and disposal as public nuisances of any abandoned, wrecked, dismantled, or inoperative vehicles or parts thereof. The AVA Authority apportions and distributes service fee proceeds to each member agency according to the formula set forth in California Vehicle Code Section 22710.


Since the establishment of the program in June 1994, it has disbursed $22,952,216 in service fee proceeds to member agencies and caused the abatement of approximately 146,561 abandoned, wrecked, dismantled, or inoperative vehicles located in various cities and the unincorporated area of Riverside County.


During Fiscal Years 2019-2022, the City of Murrieta (City) towed approximately 59 abandoned, wrecked, dismantled, or inoperative vehicles using the Abandoned Vehicle Abatement program. 

In order to continue participating in the program, the City Council must approve the County’s standard agreement, which will be received by the City at a later date upon the transmittal of signed Resolution No. 23-4711 and the County’s processing. The agreement provides for a 10-year extension of the program.

 

FISCAL IMPACT

The City of Murrieta has recovered $21,148.67 in abandoned vehicle abatement services from 2019 through 2022.  The program also gives the City of Murrieta the ability to participate in the Tipping Fee program.  Without participation in the Abandoned Vehicle Abatement program, the City of Murrieta is not eligible for the cost recovery from the Tipping Fee program. During Fiscal Years 2019-2022, the Tipping Fee program provided $69,867.00 in cost recovery for vehicle and graffiti abatements.


A revenue budget was included in the Fiscal Year 2023/24 Operating Budget for the collection of the Tipping Fee and Abandoned Vehicle Abatement programs.
