ABSTRACT
Staff has deemed construction of the Fire Station 2 Phase 1 Emergency Showers and Restroom Renovation Project (Project), CIP No. 21038, to be substantially complete and recommends moving forward with recording a formal Notice of Completion for the Project with the City Clerk.

Accept the improvements for the Fire Station 2 Phase 1 Emergency Showers and Restroom Renovation Project, Capital Improvement Plan (CIP) No. 21038, as complete;
Authorize the City Clerk to record a Notice of Completion; and
Authorize the final payment to the Contractor of owed retention and release bonds in accordance with State law and City ordinance.

PRIOR ACTION/VOTE
On June 3, 2025, City Council approved Resolution No. 25-4836, approving the Capital Improvement Plan Budget for Fiscal Year 2025/26, and the Fiscal Years 2025/26 to 2029/30 Capital Improvement Plan, which included the Fire Station 2 Improvements Project, CIP No. 21038 (Vote: 5-0).
On December 2, 2025, City Council adopted Resolution No. 25-4898, declaring an emergency condition for the Fire Station 2 Showers and Restroom and approving the execution of a Public Works Contract for the restoration of showers and restroom facilities at Murrieta Fire and Rescue Station 2 without notice for bids pursuant to California Public Contracts Code Sections 1102, 20168, and 22050 (Vote: 5-0).
On January 20, 2026, the City Council adopted Resolution No. 26-4904, terminating the Emergency Declaration in connection with the restoration of showers and restroom facilities at Murrieta Fire and Rescue Station 2 (Vote: 5-0).
STRATEGIC ALIGNMENT
The City Council’s goal of providing a high level of innovative public safety is associated with this Tier 1 project.
DISCUSSION
In November 2025, a water leak was discovered in the walls of the living quarter showers and restroom at Murrieta Fire & Rescue (MFR) Station 2 (Station 2), and subsequent testing by a certified environmental health company confirmed the presence of mold. A separate mold remediation company was hired to isolate the area, treat the mold, and remove affected building materials from the premises.
On December 2, 2025, the City Council adopted Resolution No. 25-4898 declaring an emergency condition for the Project and approving the execution of an Emergency Public Works Contract (Contract) for the restoration of showers and restroom at Station 2 without notice for bids pursuant to California Public Contracts Code Sections 1102, 20168, and 22050. The City Council also authorized the City Manager to execute the contract on behalf of the City in an amount up to $190,000, plus a 15% contingency.
An Emergency Public Works Construction Contract was negotiated with Capital Construction, Inc. in the amount of $127,772, plus a 15% contingency of $19,165.80, which was executed on January 5, 2026. Construction began on January 12, 2026, and was deemed substantially complete on March 18, 2026, with final completion on April 1, 2026.
Final payment and retention release has not yet been made, however it is anticipated that the project will close out approximately 4%, or $4,774.44, over the original contract value due to City requested Contract Change Orders negotiated during construction for an anticipated final Contract amount of $132,546.44.
PUBLIC NOTICING
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
CEQA AND REGULATORY OVERVIEW
This project is recommended for exemption from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Guidelines because this project consists of operation and repair to an existing facility with no expanded use.
FISCAL IMPACT
The total anticipated final construction costs of $132,546.44, were provided by the General Fund Capital (Fund 112) in CIP No. 21038. The total approximate project costs, including permits, design and construction, totaled $155,070.71.
