RECOMMENDATION
recommendation
1. Consider and approve the Notice of Exemption pursuant to the California Environmental Quality Act Guidelines (CEQA), (see Attachment 3); and
2. Adopt a Resolution entitled: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MURRIETA TO APPROVE TENTATIVE PARCEL MAP 38891 (PLAN-MAPS-2024-00021), A MAP CONSOLIDATING TWO LOTS INTO ONE PROJECT SITE ASSOCIATED WITH THE DEVELOPMENT OF AN APPROVED CONVENIENCE STORE AND FUELING STATION BASED ON THE FINDINGS AND SUBJECT TO THE CONDITIONS OF APPROVAL IN EXHIBIT A (APN’S: 392-270-057, 392-270-058).
body
ENVIRONMENTAL
The project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Title 14, Division 6, Chapter 3 of the California Code of Regulations, Section 15315 (Minor Land Divisions) Class 15, the Tentative Parcel Map is consistent with the Project site’s General Plan and zoning designation, no variances or exceptions are required, all services and access to the parcels to City standard are available, the lots were not involved in a division of a larger parcel within the previous 2 years, and the project site has an average slope of less than 20%.
EXECUTIVE SUMMARY
The City Council approved Substantial Conformance 2023-00001, on June 20, 2023, to develop a convenience store and fueling station on the project site. The approval conditions required a Tentative Parcel Map (Map) to be submitted and approved before construction. The Applicant is implementing its conditions of approval and has submitted this Map to satisfy the associated conditions and to begin the next phase of construction. The proposed Map effectively redraws the boundaries of existing parcels and creates one property. The Map also results in the elimination of encumbrances from existing parcels, providing the Applicant with what is effectively a new property on which to develop his approved project.

Development of the triangular site, SC-2023-00001, was approved by the Planning Commission on March 22, 2023 (see Attachment 2 for stamped approved site plan) and upheld by the City Council on 6-20-2023 for developing a convenience store and fueling station and was conditioned to process a Parcel Map to re-map the various parcels and abandoned streets into a single parcel. Under the Development Code (Title 16 of the Murrieta Municipal Code) and Substantial Conformance (SC) 2023-00001 conditions of approval, the Project proposes a Tentative Parcel Map described by Chapter 16.94 of the Murrieta Municipal Code for re-mapping of the project site associated with the development of an approved convenience store and fueling station (see Attachment 4.b. for the Tentative Parcel Map).
Zoning / General Plan Consistency:
The proposed Tentative Parcel Map is consistent with and implements the City’s General Plan, the Goals and Policies outlined in the Plan, and the Development Code. The Development Code and General Plan findings are in the Resolution (Attachment 1).
Tentative Parcel Map:
The existing property comprises two parcels (APN 392-270-058 and 392-270-065) and Catt Road. This map includes Lot A for street dedication, relinquishing access off Clinton Keith Road except for a 20-foot access opening, a street vacation, and merging two parcels. Lot A is for the right turn deceleration lane that was part of the project design for the approved SC-2023-00001, a convenience store, and fueling station. The 20-foot access opening will allow secondary access to the site consistent with the approved site plan for SC-2023-00001. Catt Road will be vacated through this parcel map process and incorporated into the project area. Antelope Road (Kalmia Street) has been officially vacated through a separate document and constitutes a portion of the two parcels. Antelope Road (Kalmia Street) was granted to a private entity by the State in 1971 and is part of the project boundary. Antelope Road has several reservations (easements) that will be vacated through this parcel map process. The parcel map will consolidate the parcels, Antelope Road (Kalmia Street) easement vacations, and Catt Road Street vacation into one parcel totaling 1.80 gross acres and Lot A for street dedication.
NOTICING
The Project's public notice was provided under Chapter 16.76 of the Development Code, consisting of a published public hearing notice in the Press Enterprise newspaper, a posted sign on the property, and notices mailed to all property owners within 300 feet of the project.
