Award the construction contract for the Tot Lot Improvement Project Phase 1, CIPs 22026, 22035, 22036, and 22038, to the lowest responsible bidder, Millsten Enterprises, Inc., in the amount of $1,344,667.35, plus a 15% contingency;
Authorize the Mayor to execute the agreement; and
Amend the Fiscal Year 2024/25 Capital Improvement Plan Budget to provide additional budget appropriation for CIPs 22026 and 22038.

PRIOR ACTION/VOTE
On May 16, 2023, the City Council approved Purchase Orders for Landscape Structures, Inc., Gametime, Michael Baker International, and Anser Advisory in the amount of $1,658,659 for the purchase of tot lot equipment, engineering design services, and project/construction management services, respectively (Vote: 5-0).
On August 15, 2023, the City Council adopted Resolution No. 23-4699, approving the Fiscal Years 2023/24 to 2027/28 Capital Improvement Plan (Vote: 5-0).

BACKGROUND
The City of Murrieta (City) operates 53 parks, 32 of which have some form of tot lot playground equipment. As some of this infrastructure has been in place since the City’s founding, new equipment needs to be installed. This project will install new equipment at two (2) locations and construct access points and ramps to the play equipment that comply with current requirements for the Americans with Disabilities Act (ADA), which will significantly increase the level of service for individuals with disabilities. Additionally, completely new playgrounds will be constructed at three (3) of the four (4) locations where none exist today.
In late 2022, staff embarked on a project to design and construct the replacement of tot lot equipment at nine (9) locations. Due to the size of the project, staff separated these into two separate phases. The current phase applicable to this agenda report is for the four (4) tot lots at: Northstar Park, Monte Vista Park, Palomar Park, and Oak Terrace Park. Construction will involve grading, proper drainage, and pouring structurally required concrete footings and walkways, new tot equipment, and engineered wood chip play surfaces.
The City published the bid opportunity to PlanetBids on May 1, 2024, publicly advertised the Project in a regional newspaper on May 15, 2024, and again on May 25, 2024, and received three (3) construction bids on June 5, 2024, as follows:

The bids were reviewed, and the item prices were determined to be consistent with today’s construction market. The additive bid items are for the purchase and installation of a sump basin to aid in rainwater drainage at one (1) of the tot lot locations if needed.
Staff recommends that the contract be awarded to the lowest responsible bidder, Millsten Enterprises, Inc., in the amount of $1,344,667.35, plus a fifteen percent (15%) contingency of $201,700.10, for a total contract amount of $1,546,367.45.
No bid protests were received for the Project.

ENVIRONMENTAL IMPACT
Pursuant to Section 15303, New Construction or Conversion of Small Structures, Article 19. Categorical Exemptions, of the California Environmental Quality Act, this project is exempt as it consists of construction of limited numbers of new, small facilities or structures at locations already zoned for Parks.
