Award the construction contract for the Town Square Park Amphitheater Parking Lot and Entryway Monument Project, Capital Improvement Project 10041, to the lowest responsible bidder, DeArk E&C, Inc., in the amount of $2,345,755.00, plus a 15% contingency;
Amend the Fiscal Year 2024/25 Operating Budget and Capital Improvement Plan Budget to provide an additional budget appropriation for Capital Improvement Project 10041; and
Authorize the Mayor to execute the agreement.

PRIOR ACTION/VOTE
On June 4, 2024, the City Council adopted Joint Resolution No. 24-4745, approving the Capital Improvement Plan budget for Fiscal Years 2024/25 and the Capital Improvement Plan for Fiscal Years 2024-25 to 2028/29 (Vote: 5-0).

BACKGROUND
The Town Square Park Amphitheater is a significant recreational venue for the Murrieta community and a central feature of the civic center complex. To improve accessibility and enhance the area's aesthetic appeal, the City plans to construct a new parking lot and an entryway monument. These improvements are expected to provide required Americans with Disabilities Act (ADA) compliant parking, facilitate better traffic management, and create a welcoming atmosphere for visitors.
Improvements include:
• Grading and construction of a ninety-one (91) space parking lot on a lot directly north of Town Square Park, which includes five (5) ADA compliant parking stalls.
• ADA walkways, lighting, and landscaping.
• Drainage improvements to the lot north of the parking lot that will prevent the accumulation of standing water during the rainy season.
• Installation of trees and other plantings along the southside of Kalmia Street from Jefferson Avenue to Adams Avenue.
• Construction of a downtown entryway monument at the southwest corner of Kalmia Street & Jefferson Avenue that will include two (2) five by ten-foot video boards to provide information to the public through static graphics, raised seating walls, landscaping, and lighting.
• The traffic control and electric service cabinets on the southwest corner of Kalmia Street and Jefferson Avenue will be relocated to the northwest corner of the same intersection to provide better visibility of the video boards.
A bid opportunity for this project was initially published on June 24, 2024, and bids were received from five (5) contractors. However, all bids were significantly higher than the project budget, and all were rejected with the concurrence and approval of the City Manager.
Staff reworked the project bid sheet and identified certain project components to be included as additive bid items so the City could balance the project scope with the approved project budget. The City republished the competitive bid opportunity for this project to PlanetBids on August 16, 2024, publicly advertised the project in a regional newspaper on August 20, 2024, and again on August 30, 2024, and received eight (8) bids prior to the deadline of 2 p.m. on September 12, 2024, as follows:

The total bid amount was the basis for awarding the project. The bids were reviewed, and the item prices were determined to be consistent with today’s construction market. The lowest responsive bid was approximately ten percent (10%) lower than the lowest bid from the previously rejected round of bidding.
Staff recommends that the contract be awarded to the lowest responsible bidder, DeArk E&C, Inc., in the amount of $2,345,755.00, plus a fifteen percent (15%) contingency of $351,863.25.
If significant issues are encountered during construction that requires spending a large portion of contingency funds, staff will still have the option of foregoing some additive bid items to ensure the overall project costs stay within the established project budget.
No bid protests were received for the Project.
FISCAL IMPACT
The Town Square Park Amphitheater Parking Lot and Entryway Monument Project, CIP 10041, has an available budget of $2,309,027.87. Staff would like to complete the additive bid items as part of the initial construction. To fund the fifteen percent (15%) contingency, the additive bid items, and other intergovernmental fees, staff is requesting an additional budget appropriation of $456,090 from three funding sources, as shown in the table below.
