Amend the Fiscal Year 2024/25 Capital Improvement Plan budget and reopen the California Oaks Road at I-15 Interchange Project, Capital Improvement Plan (CIP) No. 8147; and

Allocate Unassigned Fund Balance from Freeway Development Impact Fees (DIF) Fund 128 in the amount of $250,000 into CIP No. 8147.

PRIOR ACTION/VOTE

On December 4, 2007, the City Council adopted Resolution No. 07-1906, authorizing the City Manager to enter into an agreement with RBF Consulting for professional engineering services related to the design of the California Oaks Road at I-15 Interchange Project, CIP No. 8147, in the amount not to exceed $1,535,300 (Vote 5-0).

 

On January 18, 2011, the City Council adopted Resolution No. 11-2659, awarding the construction contract for the California Oaks Road at I-15 Interchange Project, CIP No. 8147, to the lowest responsible bidder, Granite Construction, in the amount of $11,128,000 (Vote 5-0).

 

On December 5, 2017, the City Council adopted Resolution No. 17-3830, accepting the improvements for the California Oaks Road at I-15 Interchange Project, CIP No. 8147, as complete and directing the City Clerk to record a Notice of Completion and release bonds in accordance with State Law and City Ordinances (Vote 4-0-1).

 

On June 4, 2024, the City Council adopted joint Resolution No. 24-4745, approving the Capital Improvement Plan Budget for Fiscal Year 2024/25 and the Fiscal Years 2024/25 to 2028/29 Capital Improvement Plan (Vote 5-0).

BACKGROUND

The California Oaks Road at I-15 Interchange Project, CIP No. 8147, was a joint venture project with Caltrans that consisted of constructing loop on-ramps for both north and southbound traffic and widening the associated off-ramps. Other improvements included widening California Oaks Road and eliminating crossing left turn movements to further enhance the interchange's circulation.

 

RBF Consulting (now Michael Baker International) began designing the project on December 4, 2007. The construction contract was awarded to Granite Construction on January 18, 2011. Construction started in April 2011, and was deemed substantially complete in September 2012. The project notice of completion was approved by the City on December 5, 2017.

 

On November 27, 2023, staff received an email from Caltrans personnel requesting an update on the status of project closeout for the California Oaks Road and I-15 Interchange Project. Upon further investigation, it was discovered that properties acquired during the Right-of-Way (ROW) acquisition stage of the project had never been formally transferred over to Caltrans. A total of seven properties were obtained during the ROW acquisition process. Three of the properties were acquired without the necessary restrictive access rights that are required on all Caltrans properties. Caltrans requires that these restrictive access rights be acquired prior to the properties being transferred over to Caltrans and formally closing out the project.

 

To complete the necessary work, Monument Consulting will provide ROW services, such as obtaining the restrictive access rights and transferring the seven subject properties to Caltrans. Michael Baker International (MBI) will be updating survey maps, plat and legal descriptions, the boundary survey, final monumentation, and the Record of Survey, all in support of Monument Consulting’s right-of-way efforts to satisfy the required closeout procedures by Caltrans. Staff will utilize existing on-call consulting agreements with Monument Consulting and MBI in order to proceed with the above-mentioned services. The services are estimated to cost as follows:

Staff is requesting that CIP 8147 be reopened and that $250,000 of unallocated Freeway Development Impact Fees (DIF) funds be appropriated into CIP 8147 to cover the above-referenced costs. The excess funding request is to cover unanticipated expenses should they arise. Unused funding will be returned to the unallocated fund balance after the project is closed.

 

FISCAL IMPACT

Freeway DIF funds (128) are available in the amount of $250,000. CIP 8147 was closed during the Fiscal Year 2021/22 Capital Improvement Plan budget, and the remaining Freeway DIF funds were reverted back to the fund balance. Therefore, sufficient fund balance is available to establish an appropriation of $250,000.
