Approve an agreement with M. Pino and Associates, Inc. for background investigations for Concealed Carry Weapon License applicants and waive the bidding requirements as allowed per Municipal Code Section 3.08.280; and
Amend the Fiscal Year 2024/25 Operating Budget associated with the General Fund and Measure T Fund as discussed below.

PRIOR ACTION/VOTE
On September 1, 2020, the City Council adopted Resolution 20-4301 and approved an amendment to the agreement with M. Pino and Associates, Inc. related to background checks for Concealed Carry Weapon Licenses and amended the Fiscal Year (FY) 2020/21 Operating Budget to appropriate an additional $20,000 per year for the services (Vote: 5-0).

BACKGROUND
M. Pino and Associates, Inc. (MPA) has performed background investigations for applicants for the Police Department’s (PD) Concealed Carry Weapon (CCW) program since the program’s inception in 2017. MPA has successfully streamlined the application process using secure online CCW background application software. Due to the efficiency of the software and the knowledgeable staff employed by MPA, most initial background investigations are completed within four months, and renewals within one month. MPA is also contracted by the Menifee, Hemet, and Banning police departments and 16 other cities in Los Angeles for CCW background investigation services.
MPA is the only vendor currently offering this service. To conduct the CCW investigations in-house, the PD would require at least one additional full-time Detective II position and an increase in funding to support extended work hours the position may require.
Section 3.08.280 of the Municipal Code authorizes that the City’s competitive bidding procedures and requirements may be dispensed when the commodity or service can be obtained from only one vendor.
FISCAL IMPACT
Costs for these services average $60,000 per fiscal year. The proposed agreement has a not-to-exceed value of $400,000 for five years or $80,000 per fiscal year. The additional $20,000 per year is a buffer to allow for an increase in applications during busy years of the CCW program.
The Police Department has $120,000 approved in the FY 2024/25 Measure T Fund Operating Budget in account 1113120-60480. Staff requests that the $120,000 budget in the Measure T account 1113120-60480 be released and a new budget of $80,000 be established in the General Fund Operating Budget account 1103120-60480.
The budget for subsequent fiscal years of the agreement will be included in the routine biennial budget process.
