ABSTRACT
Domenigoni-Barton Properties, LLC and Tres Estrellas, LLC have applied to abandon or vacate Lot A of Parcel Map 28280 to facilitate development within the Triangle area bounded by Murrieta Hot Springs Road, Interstate 15, and Interstate 215. Staff determined that the right-of-way is excess and no longer needed under the General Plan, while Southern California Edison has requested that an easement be reserved for utility purposes. Engineering staff has reviewed the proposed vacation for compliance with applicable state and municipal requirements and recommends proceeding with the general vacation of Lot A.

Adopt Resolution No. 26-4974 entitled: A Resolution of the City Council of the City of Murrieta, California to Set a Public Hearing for the Abandonment of Lot A of Parcel Map 28280 and Causing the Publishing and Posting of the Notices Pursuant to the Streets and Highway Code Sections 8300 et. seq; and
Authorize the City Manager to execute any required documents in a form approved by the City Attorney as necessary to effectuate the transfer of easement.

STRATEGIC ALIGNMENT
This item aligns with the City Council goal to maintain a high performing organization that values fiscal sustainability, transparency, accountability and organizational efficiency. The proposed vacation is consistent with the General Plan and supports the planned use and development of the area.
DISCUSSION
An application was filed by Domenigoni-Barton Properties, LLC, and Tres Estrellas, LLC, the applicants, to abandon or vacate Lot A of PM 28280. The land proposed for abandonment consists entirely of Lot A, an irregularly shaped parcel located in the southern portion of the subdivision, adjacent to Interstate 15. The lot is situated near the southern/eastern edge of the development and is bounded by subdivision property and roadway/access areas.
The applicant is developing a portion of the Triangle development, bounded by Murrieta Hot Springs Road, Interstate 15, and Interstate 215, and is required to vacate Lot A to support this development. Staff has reviewed the application and has determined that the requested right-of-way to be abandoned is excess and is no longer needed per the General Plan. Utilities have been notified, and there is a request from Southern California Edison (SCE), a public utility, to reserve an easement. Therefore, staff recommends completing a general vacation of the requested portion of the right-of-way. Staff has reviewed the proposed abandonment for conformance with the Streets and Highway Code Chapter 4, Part 3, Division 9 and the Murrieta Municipal Code. The legal description (Exhibit “A” to the Resolution) describes the location of the right-of-way to be abandoned. Lot A is graphically shown on sheet 3 of Parcel Map 28280 (Exhibit “B” to the Resolution).
The abandonment of Lot A was presented to the Planning Commission on September 23, 2026, where it found that the abandonment was consistent with the General Plan.

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
FISCAL IMPACT
The fiscal impact associated with this report is approximately $1,100, for public notification. Funding is available in the Engineering Department operating budget.
