PRIOR ACTION/VOTE

On June 20, 2023, the City Council adopted Resolution No. 23-4674, approving a Tentative Agreement for a Successor Memorandum of Understanding between the City of Murrieta and the Murrieta Police Management Association for the period July 1, 2023, through June 30, 2026  (Vote: 4-0-1).

DISCUSSION

Most employees of the City of Murrieta (City) are represented by employee organizations and governed by a Memorandum of Understanding (MOU) between the City and their representative employee organization setting forth compensation, benefits, and other terms and conditions of employment for those represented employees. Through collective bargaining, the City regularly and routinely negotiates with the respective employee organizations to update those terms and conditions. All such items must be voted on and passed by a majority of the membership of each affected employee organization, known as ratification, and subsequently approved by the City Council before becoming effective. Once approved by the City Council, the terms of tentative agreements for successor MOUs are required to be memorialized in the successor MOU and brought back to the City Council for final approval per Section 3505.1 of the Meyers-Milias-Brown Act (MMBA).

 

The previous MOU between the City and the Murrieta Police Management Association (MPMA), adopted by City Council Resolution No. 21-4444, covered the period July 1, 2021, through June 30, 2023. MPMA currently represents eight sworn public safety City employees, including six (6) Police Lieutenants and two (2) Police Captains. 

 

The City and MPMA representatives met and conferred in good faith in 2023 and reached a Tentative Agreement on a fair and equitable package of total compensation for a successor MPMA MOU for the period July 1, 2023, through June 30, 2026. The members of the MPMA voted to ratify the Tentative Agreement, and the City Council approved the Tentative Agreement on June 20, 2023, per Resolution No. 23-4674.

 

Pursuant to MMBA section 3505.1, the labor representatives of the City and MPMA subsequently met, conferred, and mutually prepared a written successor MPMA MOU 2023-26, consistent with the Tentative Agreement deal points approved by the City Council on June 20, 2023.

 

The parties intended to include holiday pay and leave cash-out language that would meet CalPERS criteria for Special Compensation and have been working with CalPERS to obtain approval of the necessary language. However, the process has taken longer than anticipated, and the parties do not wish to further delay the approval of the MOU.

 

If CalPERS ultimately requires additional language changes or does not approve holiday pay as Special Compensation under this MOU, then the parties agree to reopen that applicable Article to meet and confer over the impacts of CalPERS’ determination. Staff has prepared a Resolution (Attachment No. 1), which includes a fully executed copy of the successor MPMA MOU for the period July 1, 2023, through June 30, 2026, which remains subject to final City Council approval, adoption, and implementation.

 

FISCAL IMPACT

The fiscal impact for the MPMA MOU 2023-26 three-year (3) term, which includes Fiscal Years (FY) 2023/24, 2024/25, and 2025/26, is $2,066,611. A budget adjustment for FY 2023/24 and FY 2024/25 was included in the mid-year budget update last year based upon the previously approved Tentative Agreement for the successor MPMA MOU 2023-26.  The fiscal impact for FY 2025/26 was included in the biennial Operating budget.
