PRIOR ACTION/VOTE
On September 18, 2007, the City Council adopted Resolution No. 07-1815, approving an agreement with Animal Friends of the Valleys for animal control services (Vote: 5-0).
On June 16, 2009, the City Council adopted Resolution No. 09-2300, approving a one-year extension to the agreement with Animal Friends of the Valleys for animal control services
(Vote: 5-0).
On June 15, 2010, the City Council adopted Resolution No. 10-2528, approving an extension to the agreement with Animal Friends of the Valleys for animal control services (Vote: 5-0).
On December 15, 2015, the City Council adopted Resolution No. 15-3481, approving an amendment to the agreement with Animal Friends of the Valleys for animal control services
(Vote: 4-0-1).
On December 15, 2020, the City Council adopted Resolution No. 20-4344, approving an amendment to the agreement with Animal Friends of the Valleys for animal control services (Vote: 4-0).

BACKGROUND
Since incorporation, the City of Murrieta (City) has contracted with Animal Friends of the Valleys, Inc. (AFV) for animal control services. AFV's services include animal control field services, after-hours emergency response, and enforcement of animal-related ordinances. The current agreement with AFV was entered into on December 21, 2010. The agreement has been amended twice and has been extended on an annual basis since 2020, when it was amended to allow for ongoing annual extensions.
The City has two agreements with AFV. The proposed restated agreement (Attachment 1) is for animal control services within the City limits. The other agreement is between the City and the Southwest Communities Finance Authority (SCFA), a Joint Power Authority (JPA), for animal sheltering services.
The services included in the proposed agreement are for enforcement of State laws and local ordinances, impound and removal of animals, complaint investigation and resolution of animal-related issues, regular field services, and emergency and after-hour field services response within the City. The cost schedule submitted by AFV is based on the number of animal control officers committed to Murrieta (plus backup when necessary), vehicle mileage, and other administrative costs. The City is not fully burdened for the cost of AFV operations, which is offset by estimated revenues from collections of licenses, citations, and AFV collections. The total cost for Fiscal Year (FY) 2024/25 is $120,000 annually, for a monthly rate of $10,000.

A restated agreement is necessary, as AFV has requested modifications to the agreement beyond what is allowed in the amendment, specifically, the addition of a cost-of-living adjustment (COLA) to the agreement. The COLA adjustment is included in Attachment 1 and is capped at a maximum of 2.5% annually over the next three fiscal years. Additionally, the City requested an increase to the General Liability Insurance covering AFV and the City from $1 million to $2 million, which is the current standard limit for services within the City. No changes to the scope of work or services provided by AFV are included in the proposed agreement.
An RFQ/RFP process was not considered for the following reasons:
• Minimal cost increase requested by AFV for the currently contracted services;
• All SCFA jurisdictions currently contracting with AFV for animal control services;
• AFV's current agreement with SCFA for animal sheltering services; and
• AFV's operation service with minimal customer service complaints.
FISCAL IMPACT
The total cost of this service agreement in FY 2024/25 will be $120,000. There is no anticipated budgetary impact in FY 2024/25, as the budget was established as part of the biennial budget adoption. However, with the addition of the cost-of-living adjustment provision in this agreement, the City can expect a cost increase of up to 2.5% in years two and three of the contract. The Operating budget for FY 2025/26 and 2026/27 will be established as part of the upcoming biennial budget process.
