DISCUSSION
On February 6, 1990, the County of Riverside approved and filed Tract Map 21151, which included a dedication for public drainage easement purposes for a portion of Lot 31 (Map 21151 Dedication). This offer of dedication was not accepted by Riverside County on the map at the time of recordation.
This pertains to a subdivision that was developed in the early 1990s by Robert H. Lintz, along Gibraltar Road off of Los Alamos Road between Vista Murrieta and Hancock Avenue.
The Riverside County Flood Control and Water Conservation District (District) has a storm drain system that was constructed in association with Tract Map 21151. Per the conditions of development and terms in the Cooperative Agreement executed by and between the District, County of Riverside, and Robert H. Lintz, an easement for the maintenance of this facility was dedicated to the public within said map.
The above-referenced offer of dedication is on the northwest portion of Lot 31 (Dedication Area). The City of Murrieta (City) was incorporated in 1991, and accordingly, the subject Lot automatically transferred to the City pursuant to Government Code Section 57329. As a result of the City’s incorporation, the Dedication Area is within the City of Murrieta.
Staff recommends rescinding the above-referenced prior rejections of the offers of dedication and now accepting them.
Staff prepared a quitclaim deed, and the Department of Public Works has completed checking the legal descriptions for conformance with the Subdivision Map Act and the Murrieta Municipal and Development Codes. The legal descriptions conform substantially to the requirements therein.
