RECOMMENDATION

Award the construction contract for the Murrieta Hot Springs Road Pavement Rehabilitation Project CIP No. 13047 to Onyx Paving Company, Inc. in the amount of $1,991,000;
Authorize a fifteen percent (15%) construction contingency of $298,650; and
Authorize the City Engineer to approve contract change orders not to exceed fifteen percent (15%) of the contract amount.

PRIOR ACTION/VOTE
On June 4, 2024, the City Council approved joint Resolution No. 24-4745, et al., approving the Capital Improvement Plan Budget for Fiscal Year 2024/25, and the Fiscal Years 2024/25 to 2028/29 Capital Improvement Plan, which included the Murrieta Hot Springs Road Pavement Rehabilitation Project, CIP No. 13047 (Vote 5-0).
On April 2, 2024, the City Council authorized the City Manager to accept the CalRecycle Grant No. TRP16-23-0020 award in the amount of $145,720 from the State of California Environmental Protection Agency; Ratified execution of the agreement; Amended the Fiscal Year 2023/24 Capital Improvement Plan Budget to appropriate an expenditure budget in CIP Project No. 13047; and Amended the Fiscal Year 2023/24 Operating Budget to appropriate a grant revenue budget (Vote 5-0).

BACKGROUND
The Murrieta Hot Springs Road Pavement Rehabilitation Project, CIP No. 13047 will rehabilitate Murrieta Hot Springs Road from Whitewood Road to Margarita Road which is approximately 0.7 miles in length. Improvements consist of removal and replacement of pavement failure sections, full-width roadway grinding of existing asphalt, placement of asphalt rubber hot mix (ARHM) overlay, detector loop replacement, signing and striping, full structural section removal and replacement adjacent to the Warm Springs Creek bridge, and removal and replacement of concrete curb ramps. Other work includes the removal and replacement of the curb and gutter, spandrel, and cross gutter at the intersection of Weeping Willow Lane and Thoroughbred Lane. CIP No. 13047 is funded by the Road Repair and Accountability Act of 2017 (SB1) and the Rubberized Pavement Grant Program (CalRecycle).
Project Bidding and Determination
The City advertised the project on July 11, 2024, and received a total of six construction bids on August 1, 2024. The basis of the bid for determining the lowest bidder was defined in the specifications as the sum of the total base bid items and the additive bid item. The results are as follows:

Staff has elected to utilize Additive Bid Item 43, “Double Adjust Sewer Manhole”. As part of a pending reimbursement agreement with Eastern Municipal Water District (EMWD), this bid item was advertised as an additive bid item in order to give EMWD the opportunity to self-perform their own adjustments. EMWD has elected to have ONYX Paving Company Inc. perform the adjustments of its facilities and will reimburse the City the full amount for Additive Bid Item 43 in the amount of $57,000 upon execution of said reimbursement agreement.
The Public Works Engineering Department has reviewed the bids and determined that the item prices are consistent with today’s construction market and recommends that the contract be awarded to the lowest responsible bidder, ONYX Paving Company Inc., in the amount of $1,991,000 for the Total Base Bid and the Additive Bid Item, plus a fifteen percent (15%) contingency of $298,650, for a total of $2,289,650.
FISCAL IMPACT
The proposed contract amount to be awarded is $1,991,000, plus an additional fifteen percent (15%) contingency amount of $298,650, for a total of $2,289,650. Funding is available in CIP No. 13047.
