ABSTRACT

The proposed Cooperative Agreement with Caltrans will allow the City to be reimbursed for work completed by the City utilizing Federal funds administered by Caltrans, whereas the 2024 cooperative agreement does not include the option for reimbursement.

Adopt Resolution No. 26-4927 entitled: A Resolution of the City Council of the City of Murrieta, California, Approving A Cooperative Agreement with the State of California, Acting By and Through Its Department of Transportation (CalTrans), for the Plans, Specifications, and Estimates and Right of Way Work Necessary to Construct A New Full Interchange and Auxiliary Lanes at Interstate 215 and Keller Road (District Agreement No. 08-1822).

PRIOR ACTION/VOTE

On October 4, 2011, the City Council adopted Resolution No. 11-2798, authorizing the entry into Cooperative Agreement 08-1519 with Caltrans for the Interstate 215/Keller Road Undercrossing (Vote 5-0).

 

On May 15, 2015, the City Council adopted Resolution No. 15-3371, authorizing the entry into Cooperative Agreement 08-1601 with Caltrans for the Interstate 215/Keller Road Undercrossing (Vote 5-0).

 

On October 15, 2024, the City Council adopted Resolution No. 24-4790, authorizing the entry into Cooperative Agreement 08-1789 with Caltrans for the Interstate 215/Keller Road Undercrossing (Vote 5-0).

 

On June 3, 2025, the City Council approved joint Resolution No. 25-4836, et al., approving the Capital Improvement Plan Budget for Fiscal Year 2025/26, and The Fiscal Years 2025/26 to 2029/30 Capital Improvement Plan, which included the Interstate 215 at Keller Road Interchange Project, CIP No. 8449 (Vote 5-0).

 

STRATEGIC ALIGNMENT

This item aligns with the City Council to: planning, programming and creating infrastructure development relating to priority Tier 1.

 

DISCUSSION

As the project proceeds to the next phase of the design and right-of-way processes, it is necessary to enter into a new agreement with Caltrans to accommodate the work and allow the City of Murrieta (City) to be eligible for reimbursement of Federal funds administered by Caltrans. The previous agreement, approved in 2024, does not allow for the reimbursement of Federal funds administered by Caltrans. This agreement specifically obligates the DEMO Funds and the Community Project Funded Congressional Directed Spending (CPFCDS) Funds, as shown in the Funding Summary of the agreement, to be eligible for reimbursement by the City for work completed by the City.  The CPFCDS Funds listed in the Funding Summary are the two earmarks received by the City via the offices of Congressman Ken Calvert ($2.6M) and Congressman Darrell Issa ($1.5M), totaling $4.1M.

 

The attached Cooperative Agreement was provided by Caltrans and is the State’s standard form agreement for work within the State right-of-way and includes the Federal funding reimbursement language. The agreement must first be approved by the City and then returned to Caltrans Headquarters for approval and execution via an electronic signature process.

 

PUBLIC NOTICING

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).

 

CEQA AND REGULATORY OVERVIEW

 

This action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly.

 

FISCAL IMPACT

There is no direct cost to the City for implementing the Cooperative Agreement. The costs related to the Plans, Specifications, and Estimate (PS&E) and Right-Of-Way (ROW) work components are those connected with the Design Services Agreement with our designated design consultant. Staff will work with the Finance Department to establish grant project accounting to account for federal fund expenses and reimbursement as part of the quarterly budget updates.
