ABSTRACT

Approval of this item accepts the public improvements for Map Book 8/359, Portion of (Por) Lot 191, APN 913-210-043, authorizes ongoing City maintenance, and approves the partial release of the associated security bonds.


RECOMMENDATION

Accept the public improvements constructed for Map Book 8/359, Por Lot 191, APN 913-210-043, located at the southeast corner of Delhaven Street and Date Street and north of Rising Hill Drive;


Authorize the City Engineer to release ninety percent (90%) of the associated improvement security bonds; and

 
Authorize the Municipal Services Department to assume ongoing maintenance of the public improvements in accordance with City maintenance standards.

STRATEGIC ALIGNMENT

This item aligns with the City Council goal of: planning, programming and creating infrastructure development relating to an administrative priority.

 

DISCUSSION

On February 7, 2023, the City of Murrieta (City) entered into an agreement with CRP/Brandywine Murrieta Apartment Owner, LLC for the construction of public improvements associated with Map Book 8/359, Por Lot 191, APN 913-210-043. The project encompassed approximately 7.8 net acres for the development of eight (8) multi-story buildings totaling 234 attached dwelling units and a clubhouse at the southeast corner of Delhaven Street and Date Street, and north of Rising Hill Drive. Required public improvements included street paving, curb and gutter, sidewalks, drive approaches, and storm drain infrastructure serving the subdivision. Construction of these improvements has now been completed. Staff from the Department of Public Works/Engineering inspected the improvements under the direction of the City Engineer and determined that the work had been completed in accordance with the approved plans and applicable City standards.

 

Acceptance of the improvements by the City Council will require the City to assume responsibility for ongoing maintenance. Consistent with City procedures, ninety percent (90%) of the improvement security bonds may be released upon acceptance, while the remaining security will be retained during the one-year maintenance period.

 

PUBLIC NOTICING

The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).

 

CEQA AND REGULATORY OVERVIEW

 

The proposed action does not constitute a 'project' within the meaning of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(b)(5), as it is an administrative, organizational, or policy-making activity that will not result in a direct or reasonably foreseeable indirect physical change in the environment.

 

FISCAL IMPACT

The City will assume responsibility for maintaining the public improvements on an ongoing basis. These annual costs are included within the Municipal Services Department’s operating maintenance budget.
