PRIOR ACTION/VOTE
On October 19, 2021, the City Council approved an agreement with Disability Access Consultants, LLC (DAC) for American Disability Act (ADA) Self-Evaluation and Transition Plan Implementation Services (Vote: 5-0).

BACKGROUND
On October 19, 2021, the City Council adopted Resolution No. 21-4480, authorizing an agreement with Disability Access Consultants, LLC (DAC) to assist the City of Murrieta (City) with implementing the American Disability Act (ADA) Self-Evaluation and Transition Plan. The Self-Evaluation and Transition Plan are legally required in order to catalog and improve barriers to people with disabilities. For the City, the Self-Evaluation included reviewing facilities, parks, programs, communications, policies, and elements of the public right-of-way, such as sidewalks, curb ramps, and devices that aid people with disabilities in crossing streets. Once the barriers were identified, a comprehensive Transition Plan was developed which lists the barriers that limit the accessibility of public rights-of-way elements, programs, activities, and services. The Transition Plan also lists the methods to remove the barriers and make facilities accessible, the schedule to get the work completed, and the names of the officials responsible for the Plan’s implementation.
In response to the Transition Plan, the City entered into another agreement with DAC in 2024, to provide a new scope of support functions and services, including ADA grievance reviews and response, maintenance of the Transition Plan, review and update of policies and procedures, and on-call consulting services for ADA-related topics. The agreement with DAC expired on December 31, 2024.
Staff recommends City Council consider entering into a new agreement (Attachment 1) with DAC for continued ADA consulting services. The first year of the contract is from April 1, 2025, to March 31, 2026, for a not-to-exceed amount of $72,800. The contract may be extended for up to two additional one-year periods upon mutual agreement by both parties.
Murrieta Municipal Code Section 3.08.280 allows for exceptions to the competitive bidding process. In this case, DAC has a substantial historical context working in this area for the City that creates efficiencies, thereby rendering the bidding process inefficient and unnecessary. For this reason, staff recommends that the City Council authorize this project as being exempt from bidding requirements, acknowledging that the bidding process would be deemed inefficient, impractical, and unnecessary to procure these services.
FISCAL IMPACT
The cost of the first year of the agreement is for a not-to-exceed amount of $72,800. Funds are available in Risk Management’s contract services budget 7018100-60480 for Fiscal Year 2024/25. Staff will request funding as part of the biennial budget development process for Fiscal Years 2025/26 and 2026/27.
