Award the construction contract for the Clinton Keith Road and Date Street Pavement Rehabilitation Project CIP No. 8043 to ONYX Paving Company, Inc. in the amount of $1,832,612.50;
Authorize a fifteen percent (15%) construction contingency of $274,891.88; and
Authorize the City Engineer to approve contract change orders not to exceed fifteen percent (15%) of the contract amount.

PRIOR ACTION/VOTE
On August 15, 2023, the City Council approved joint Resolution No. 23-4699, approving the Capital Improvement Plan Budget for Fiscal Year 2023/24 and the Fiscal Years 2023/24 to 2027/28 Capital Improvement Plan, which included the Clinton Keith Road and Date Street Pavement Rehabilitation Project, CIP No. 8043 (Vote 5-0).

BACKGROUND
The Clinton Keith Road and Date Street Pavement Rehabilitation Project, CIP 8043, will rehabilitate the pavement on Clinton Keith Road from the western-most City boundary to Rancho Mirlo Road and Date Street from Margarita Road to 700 feet to the north-east (Attachment 1). Rehabilitation on Clinton Keith Road includes asphalt removal and replacement in designated areas and full-width roadway overlay with hot mix asphalt (HMA). Other activities include asphalt concrete dike improvements, overside drain replacement, miscellaneous concrete work, signing and striping, and loop detector replacement. Rehabilitation on Date Street includes asphalt removal and replacement in designated areas, half-width roadway pavement overlay with HMA, signing and striping, and loop detector replacement. CIP No. 8043 is funded by the Road Repair and Accountability Act of 2017 (SB-1), Measure A and Gas Tax.
Project Bidding and Determination
The City advertised the project on January 18, 2024, and received nine construction bids on February 15, 2024. The bid results are as follows:

The Department of Public Works/Engineering has reviewed the bids and determined that the item prices are consistent with today’s construction market and recommends that the Contract be awarded to the lowest, responsible bidder, ONYX Paving Company, Inc., in the amount of $1,832,612.50 for the Total Base Bid, plus a fifteen percent (15%) contingency of $274,891.88, for a total of $2,107,504.38 (Attachments 2-4). The City Engineer will be authorized to approve Contract Change Orders not to exceed fifteen percent (15%) of the Contract amount.
FISCAL IMPACT
The proposed contract amount to be awarded is $1,832,612.50, plus an additional fifteen percent (15%) contingency amount of $274,891.88, for a total of $2,107,504.38. Funding is available in CIP 8043.
